Not-for-Profit Entity Obtains Tax Exemption!

The court heard the case of GBC/HDC Limited Partnership vs. Columbia County Board of Appeals, Columbia County, Berwick Borough, and Berwick Area School District. Our law firm, Hoegen and Associates, P.C, successfully represented GBC/HDC Limited Partnership and helped them to obtain tax exemption.

This case was a challenge of the GBC/HDC Limited Partnership's receipt of rental from the three commercial units within the GBC/HDC's Shane Building. Columbia County Board of Appeals, Columbia County, Berwick Borough, and Berwick Area School District challenged GBC/HDC Limited Partnership's claim that the receipt of rental income from the units disqualified the not-for-profit entity from recieving tax-exempt status. Hoegen and Associates, P.C. fought for GBC/HDC and won. The trial court determined that GBC/HDC Limited Partnership advanced charitable purposes, relieved the government of some of its burden, and operated entirely free from private profit motive. Exemption granted.
